A deposition is defined as the taking of sworn, out-of-court oral testimony of a witness i.e. a witness’s sworn out-of-court testimony.
The testimony of a party or witness in a civil or criminal proceeding is taken before litigation.
A deposition is used to collect information during the discovery process, and in some cases, this may be used at trial.
